EB-1 Immigrant Visa

For most individuals, labor certification will be the easiest and most certain route to permanent residency; however, in some cases it may be advantageous to file in another manner. An eligible EB-1 applicant may apply for permanent residency directly to the USCIS without having to receive a labor certification from the Department of Labor (DOL). These cases require significant evidence of accomplishment and recognition to be approved.

Labor Certification

US law allows employers to petition for permanent residency for foreign national employees through several different processes, the most common of which is called “labor certification”.

The foreign national may currently be employed in the position in question or may have been offered the position for a start date in the future.

Most people file through normal labor certification procedures, but special procedures may be available for teaching faculty.
